Terms of Service

1. Agreement to Terms

By creating an account or using ForgeUp (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Open Key Technologies LLC ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use ForgeUp. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@forgeup.app if you suspect unauthorized access.

You may not share your account, use another person's account, or create accounts for the purpose of abusing or circumventing the Service.

4. Subscriptions and Billing

ForgeUp Pro is available as a monthly or annual auto-renewing subscription, processed by Apple. Your subscription begins after the free trial period (if applicable) and renews automatically unless cancelled at least 24 hours before the end of the current period.

You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellations take effect at the end of the current billing period — you will retain access until then. We do not issue refunds except where required by applicable law.

We may change pricing at any time. We will give you reasonable advance notice of any price increase, and your continued use of the Service after the change takes effect constitutes acceptance.

5. Health and Fitness Disclaimer — Exercise at Your Own Risk

IMPORTANT: READ CAREFULLY BEFORE USING FORGEUP.

ForgeUp is not a medical service and does not provide medical advice, diagnosis, or treatment. The workout programs, weight suggestions, and AI coaching provided by ForgeUp are for general fitness informational purposes only and are not a substitute for the advice of a licensed physician, physical therapist, or other qualified healthcare professional.

Consult your doctor before beginning any exercise program. Before starting any new exercise program — including any program generated by ForgeUp — you should consult with a qualified healthcare professional, particularly if you:

  • Have any existing medical condition, heart condition, or chronic illness
  • Are pregnant or postpartum
  • Have had recent surgery or are recovering from injury
  • Are over 40 or have been sedentary for an extended period
  • Have high blood pressure, diabetes, or a history of heart problems
  • Experience chest pain, dizziness, or shortness of breath during exercise

You exercise entirely at your own risk. Physical exercise involves inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and in rare cases death. By using ForgeUp, you voluntarily assume all such risks. If you experience pain, dizziness, shortness of breath, or any unusual symptoms during exercise, stop immediately and seek medical attention.

You represent that you are physically capable of engaging in an exercise program and that you have obtained medical clearance where appropriate. You are solely responsible for your own health and safety during all exercise activities.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPEN KEY TECHNOLOGIES LLC, ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER HARM ARISING FROM OR RELATED TO YOUR USE OF FORGEUP OR YOUR PARTICIPATION IN ANY EXERCISE PROGRAM, WHETHER OR NOT GENERATED BY THE SERVICE.

6. AI Coaching (Milo)

Milo is an AI assistant powered by large language models. AI-generated advice, programs, and responses may be inaccurate, incomplete, or unsuitable for your individual circumstances. Use your own judgment and consult professionals where appropriate. We do not guarantee the accuracy of any AI-generated content.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access accounts or data that are not yours
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape, crawl, or access the Service
  • Transmit malware or interfere with the Service's infrastructure
  • Use the AI coaching feature to generate harmful, abusive, or illegal content

8. Intellectual Property

The ForgeUp app, website, branding, and underlying technology are owned by Open Key Technologies LLC and are protected by intellectual property laws.

You retain ownership of the workout data you enter. By using the Service, you grant us a limited license to use that data to provide and improve the Service, as described in our Privacy Policy.

9. Termination

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time through the app or by emailing support@forgeup.app. Upon termination, your right to use the Service ends.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPEN KEY TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes will be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
